EBA Guidelines on the establishment and maintenance of national lists or registers of credit servicers under Directive (EU) 2021/2167
On 5 March 2024, the European Banking Authority (EBA) has issued Guidelines (EBA/GL/2024/02) on the establishment and maintenance of national lists or registers of credit servicers under Directive (EU) 2021/21671.
The Financial Supervisory Authority (FIN-FSA) has notified the EBA that it will not comply with these Guidelines because the Directive concerned has not yet been implemented nationally and the competent authority referred to in the Directive has not been designated. The FIN-FSA will provide the EBA with a new notification at a later date if necessary.
In accordance with Article 16(3) of the EBA Regulation2, competent authorities and financial institutions must make every effort to comply with EBA guidelines.
Subject matter
The Guidelines apply to the establishment and maintenance of national lists or registers of authorised credit servicers. They specify the content, accessibility requirements and deadlines for updating the national lists or registers of authorised credit servicers. The objective is to promote a level playing field across the Union and to enhance transparency for credit purchasers and for borrowers.
The Guidelines are addressed to competent authorities as defined in Article 21(3) of Directive (EU) 2021/2167.
Entry into force
The Guidelines will enter into force on 30 December 2024.
